Terms of Service
Updated November 3, 2026
Draft for review before paid launch. Business details and these policies are being finalized.
Agreement and eligibility
These Terms govern Immersed Advertising, operated by Immersed Advertising LLC, an Indiana limited liability company. They include the SDK License Agreement (EULA), Data Sharing Addendum, Advertising Policy, AI Use Policy and Refund Policy; our Privacy Policy explains data practices, and the Legal Notices page lists further disclaimers. Advertisers are not subject to a blanket 18+ rule. You must be legally able to enter this agreement, or a parent or legal guardian must review and accept it with you where required. If you act for another person or organization, you must have authority to bind them. Provide accurate information and keep your account secure. Contact support before providing information for a child where parental consent is legally required.
What the platform provides
The platform helps advertisers upload creative, request AI restyling, review versions, and run campaigns in participating games. Developers integrate advertising and report views. Public demo worlds and free samples are fictional illustrations, not a promise of available game inventory, publisher participation, audience size, legal clearance, sales, or campaign results. A free sample does not activate a campaign or incur ad-view charges.
Your content and processing permission
You retain rights you already hold in your uploads. You grant us a non-exclusive permission to host, copy, resize, process with AI, and display the content to provide the functions you request, including through hosting and GPU service providers. Campaign content may be publicly accessible and shown in games; sample previews are restricted to your signed-in account on the website. We do not obtain ownership of your trademarks. You must obtain copyright, trademark, publicity, privacy, model and other permissions, and substantiate advertising claims. Do not upload confidential information or sensitive personal information.
AI output and human review
AI may alter text, logos, product details, likenesses or claims, and may generate inaccurate, biased, offensive, or similar output for different users. Output may not qualify for copyright protection, and we do not warrant exclusivity or freedom from third-party claims. You must review and correct output before publication. Campaign approval authorizes only the displayed version; regeneration requires another review. The original creative can serve while generated versions await approval. Follow the AI Use Policy and retain required advertising and AI disclosures.
Free new-advertiser samples
Accounts registered as advertisers after the sample feature launches receive up to three successful free generations in the listed fictional worlds. Failed or interrupted attempts do not consume a successful-sample opportunity, but attempts still count toward rate limits. Only one request may be pending per account. Availability depends on shared capacity. Limits also apply to networks, upload frequency, file size and total service workload. Do not create extra accounts, share accounts or change networks to evade the offer limits. Samples are available for 30 days; expiry does not restore used opportunities. A preview that you dislike still counts if generation completed.
Campaigns, pricing and prepaid funds
Budgets and bids are in US dollars. A budget limits a campaign and is separate from an account balance. When payments are enabled, you must fund the account before serving. Charges are based on qualifying recorded views and the CPM captured at serve time, subject to budget and balance checks. Telemetry and fraud controls have practical limits; estimated reporting may need reconciliation. Funds affected by refunds or payment disputes may become unavailable. You are responsible for authorized purchases and applicable taxes shown or legally owed. There is no promise of a particular quantity of ads, game inventory, conversions or revenue. Prices, minimum bids, fees and any other rates shown on our Pricing page or in your dashboard are current rates only. We may change them at any time; a change applies to views served after it takes effect. The developer revenue share is the one exception: it changes only as described under Developer earnings and payouts.
Final payments and billing concerns
Except where applicable law requires a refund, where we approve one after reviewing your request case by case, or as stated in this section, all payments are final and prepaid balances, including unused funds, are non-refundable. Unused funds stay in your account and keep paying for your campaigns until they are spent or you pause them. Pausing, cancelling or ending a campaign, closing your account or choosing to stop using the service does not create a refund entitlement. If we terminate your account or permanently stop providing the service to you, for any reason, we will refund the unused part of your prepaid balance, meaning funds not yet charged for ads served. If we find that views you were charged for were invalid, such as fabricated or automated views, we credit those charges back to your balance. Contact support@immersedads.com promptly about duplicate, unauthorized or incorrect charges. We will investigate. This policy does not limit mandatory remedies or lawful payment-dispute rights. See the Refund Policy.
Developer responsibilities
Developers must follow the SDK License Agreement and Data Sharing Addendum, own or have permission for game references and placements, accurately describe their games, integrate supported tracking, and maintain clear advertising disclosures and privacy notices. Obtain any player permissions the law requires before collecting or transmitting data. Games must be for players 13 and over; games directed to children under 13 may not be registered or integrated. Location matching is on by default for each game. While it is on, the game's privacy notice must tell players that Immersed Advertising receives their IP address with each ad request to estimate their country and state or province for choosing ads, without storing it; a developer that cannot provide that notice must turn location matching off. Do not fabricate views, automate traffic for earnings, obscure ads while claiming visibility, or evade controls. Developers remain responsible for their tax and reporting obligations.
Developer earnings and payouts
You earn 40% of what advertisers are charged for qualifying views in your games. A qualifying view is one the SDK reports as the SDK License Agreement describes, that an advertiser is charged for, and that is not invalid traffic. Your dashboard shows your earnings as they build up. We pay each calendar month's earnings within 30 days after that month ends (net 30), to the payout account you set up with us, once your unpaid earnings reach US $50; smaller amounts carry over to the next month. We may withhold earnings only for views we have documented as invalid traffic, such as fabricated, automated or obscured views. When we do, we tell you which earnings we are withholding and why, and you have 30 days to dispute it by writing to support@immersedads.com; we review what you send and tell you our decision. We give you at least 30 days’ notice before reducing the revenue share, and a reduction applies only to views served after it takes effect. If we reduce it, the rules that apply after you leave (see Exclusive advertising) do not apply to a game whose leaving date is within 60 days after our notice.
Exclusive advertising
While a game uses the service or contains the SDK, paid in-world placements in it are exclusive to us. A “paid in-world placement” is advertising or paid promotion shown inside the game world itself, such as on billboards, posters, signs, screens, vehicles, clothing or other objects or scenery, for which you or anyone else receives money, goods, services, a share of sales or other value, whether it comes through another advertising service or a deal made directly with a brand, agency or partner. Everything else stays allowed, including other ad formats (such as banner, video, rewarded and interstitial ads and the ad networks that provide them), your own sponsorships and brand deals that are not paid in-world placements, affiliate and referral links, your own games, products and studio branding, and credits, logos and splash screens that a license requires you to show. You may opt a game out of exclusivity at any time by writing to support@immersedads.com; from the date we confirm the opt-out, these rules, including those that apply after you leave, no longer apply to that game. After you leave the service for a game, two rules apply to that game. Your “leaving date” is the earliest of: the date you close your developer account, remove the game from the platform, or release a version of the game without the SDK. (1) For 30 days after the leaving date, the game may not include paid in-world placements from anyone other than us. (2) For 6 months after the leaving date, you may not agree to paid promotion in the game directly with an advertiser you were introduced to through the service. There is no right of first refusal, and neither rule covers promotion outside the game, such as your store page, trailers or social media. Neither rule applies if we ended your account or stopped serving the game without a breach of these Terms by you, if we stop offering the service, or after a revenue share reduction as described under Developer earnings and payouts. If we believe you have broken these rules, we will tell you in writing what we believe the breach is, and you will have 30 days to fix it, for example by removing the placement. If it is not fixed by then, we may stop serving ads in that game, and you forfeit the earnings from that game that we have not yet paid. We will not claim liquidated damages or ask you to pay our attorneys’ fees for a breach of these rules. These rules protect the advertiser relationships, technology and game-specific ad versions we invest in for each game. If a court finds any rule or part of a rule unenforceable, that part is removed and the rest still applies.
Acceptable use
Do not submit unlawful, deceptive, infringing, exploitative, sexually explicit, hateful, malicious or privacy-invasive content; impersonate people or endorsements; create non-consensual intimate imagery; or exploit children. Do not upload malware, interfere with the service, access other accounts, reverse or evade quotas, or manipulate billing and tracking. Ads must follow the Advertising Policy, including its prohibited content and its age-restricted product rules, which keep ads for alcohol, gambling, tobacco and vaping, cannabis, dating and similar products out of games open to minors. Regulated products and claims require the permissions, targeting restrictions and disclosures applicable to them. We may decline content we cannot support safely or lawfully. You may not use the service in countries or by persons subject to comprehensive US sanctions.
Restrictions, suspension and termination
To the extent applicable law allows, we may at any time reject, remove, pause or stop serving any advertisement or campaign, switch a game to contextual ads, and restrict or withdraw any feature. We may suspend or terminate an account, advertiser, company, developer or game, or anyone acting for them, or stop serving ads in a game, immediately if we reasonably believe it involves illegal activity or threatens the company, our users or players, for example through fraud, invalid traffic, malware or a security risk. Otherwise, we give at least 30 days’ notice before terminating an account or permanently stopping ads in a game, for any reason or no reason. When we end a developer account or stop serving a game, we still pay all earnings for qualifying views up to the end date, except earnings withheld for documented invalid traffic as described under Developer earnings and payouts. If we believe a game is directed to children under 13, misstates its audience or does not provide the required player notice, we may also delete data collected through it. To the extent law allows, we are not liable to you for taking any of these actions. You may stop using the service or request account closure through support. Certain transaction, consent, dispute and security records may remain as described in the Privacy Policy. If we terminate an advertiser account or permanently stop providing the service to it, we refund its unused prepaid balance as the Refund Policy describes. Suspension or termination does not override mandatory legal rights or excuse amounts you owe us.
Service warranties
To the extent law allows, the service and generated output are provided as available, without implied warranties of merchantability, fitness for a particular purpose or non-infringement. We do not guarantee uninterrupted, error-free or secure operation, and cannot guarantee AI accuracy or campaign performance. These statements do not exclude warranties or duties that applicable law does not allow us to exclude.
Limits on liability
To the extent law permits, neither party is liable to the other for indirect or consequential losses, lost profits or lost business opportunity arising from this agreement. Each party’s aggregate liability to the other arising from the service is limited to the greater of US $100 or, for an advertiser, the fees it paid us in the 12 months before the event giving rise to the claim, and for a developer, the earnings we paid or owe it for those 12 months. These limits do not apply to amounts owed under these Terms (fees an advertiser owes us, or earnings we owe a developer), fraud, willful misconduct, gross negligence, liabilities that cannot lawfully be limited, or mandatory consumer remedies.
Third-party claims
To the extent permitted by law, you agree to cover reasonable losses and costs arising from third-party or government claims caused by content you upload without required rights, your unlawful advertising, your deliberate misuse of the service, or, for developers, an inaccurate game audience declaration or your game's failure to provide the required player notice. We will notify you of the claim and reasonably cooperate. You may not settle a claim in a way that admits fault or imposes obligations on us without our consent. This provision does not make you responsible for our own misconduct or override non-waivable rights.
Disputes and applicable law
Before going to court, the party raising a dispute sends the other a written notice describing it and the outcome wanted: to us at support@immersedads.com, and to you at your account email. We both then try in good faith to resolve it for 30 days. If it is not resolved, either party may bring it in the state or federal courts located in Indiana. To the extent permitted by applicable law, the laws of the State of Indiana govern this agreement, excluding its conflict-of-law rules. Urgent matters, such as stopping fraud or protecting personal data, may go to court without waiting. Mandatory consumer protections and rights to use another required forum remain available. These Terms do not impose mandatory arbitration or waive a right that law protects.
Changes, records and contact
We may change the service, its features, prices and fees at any time, except the developer revenue share (see Developer earnings and payouts). Every version of these documents is dated, and the Legal Notices page lists what changed. Material updates to these Terms are presented for renewed acceptance before affected account actions continue. We retain the policy snapshot and acknowledgement accepted, the account, time and a hashed network identifier. If part of these Terms is unenforceable, the rest remains effective where possible. Contact support@immersedads.com for support, rights complaints, accessibility assistance or account requests.
